Article 1 – Scope

These General Terms and Conditions of Sale are intended to govern the contractual relationship between the company and any person making a purchase via the website, hereinafter referred to as the “Buyer”.

By becoming a member and/or customer, joining the company implies full and unconditional acceptance of all these General Terms and Conditions of Sale, by ticking the box provided for this purpose.

The company reserves the right to amend its General Terms and Conditions of Sale at any time. In such a case, the applicable conditions will be those in force on the date and time the Buyer places the order.

In return, the company undertakes to comply with the obligations incumbent upon it under these General Terms and Conditions of Sale.

Article 2 – Products

The company endeavours to provide the most complete possible description of the products available, through characteristics and photographs.

The characteristics featured on the product description sheets offered by the company are drawn up on the basis of information supplied by the suppliers, subject to the accuracy of such information.

With a view to continuously improving the website, the company encourages members to report any incorrect information that may appear on a product page.

The products offered for sale are sold by the company for an indefinite period and within the limit of available stocks. Depending on the suppliers, products may come from foreign countries.

The “mystery knife” operation is a marketing campaign consisting in sending a product with a minimum value of €50 and up to €150, at a single price of €34.99. The customer acknowledges that they do not know which knife they will receive, nor from which collection it will come. The item is not delivered in its original box. For this type of campaign, returns and refunds are not accepted.

Article 3 – Registration

Registration is not mandatory in order to access all products for sale on the website, except for special operations. Member status is acquired only after identification.

The company reserves the right to accept or refuse a member, or to review access rights at any time.

The new member receives a confirmation email at the email address previously entered in the registration form, which validates their registration with the company.

The member then holds a personal account through which they may place orders.

The member is fully responsible for the use and storage of their password.

In the event of loss, theft or disclosure of the password to a third party, the member is invited to reset their password via the Contact section.

By registering with the company, the member agrees to receive by email sales invitations, newsletters and/or offers from partner organisations and companies.

Article 4 – Prices

Product prices do not include shipping costs, except where a special promotion applies. The amount of the contribution to shipping costs varies according to the destination, provided that delivery takes place within the geographical area defined in Article 9 below.

The amount of shipping costs is indicated at the time the order is confirmed and is subject to the Buyer’s acceptance. A promotional code may be specified as part of a special offer granting free shipping in a given geographical area. This code must however be entered when confirming the order, and it is the Buyer’s responsibility to do so at that stage. No discount may be granted after the order has been confirmed.

The company reserves the right to modify its prices at any time; however, products will be invoiced on the basis of the prices in force at the time the order is recorded.

Article 5 – Payment security

The website uses the SSL (Secure Socket Layer) security system, which effectively encrypts all banking information via dedicated software.

No third party has access to confidential payment information. As a result, the member’s banking details, when paying by bank card, will be requested for each new order. In any event, following payment on the website, the company neither collects nor stores its customers’ confidential banking data. The credit/debit card number is never collected or stored.

Only the banking institution partnering with the company’s payment service providers (PayPal / Stripe) retains the card number and expiry date.

Furthermore, PayPal and Stripe are among the only banking institutions equipped with highly effective control, alert and blocking modules in the event of fraud, thus protecting all confidential payment data.

Article 6 – Payment terms

Payment of the order is made by bank card or via PayPal. To use this payment method, the Buyer must hold an account with PayPal.

In the case of payment by PayPal, commissions and fees are included and PayPal’s general terms of use apply.

The order confirmed by the company will only become effective upon approval by the banking payment centres, subject to the availability of the product. In the event of refusal by the banking institution, the order will automatically be suspended and the company will inform the Buyer by telephone or email and issue a refund within 48 hours.

Moreover, the company reserves the right to refuse any order from a Buyer with whom there is an existing dispute.

Article 7 – Ordering process

Orders may only be placed via the website.

Each Buyer declares and warrants that they have the legal capacity to place an order on the website.

The Buyer certifies that, on the date of the order, they are at least 18 years old or have the legal authorisation required to make a purchase on the website.

The Buyer also warrants that they are fully authorised to use the bank card provided for the transaction and that the card is not being used fraudulently, and undertakes to ensure that sufficient funds are available to cover the purchase.

Any purchase made on the website is deemed to have been made by the user of the account. All data recorded by the company constitutes proof of the transactions carried out by the Buyer on the website.

The order is only validated once the Buyer has performed a double-click, in accordance with the French law on confidence in the digital economy of 21 June 2004: a first click to place the order and a second click to confirm it. Confirmation will be deemed to constitute a signature and acceptance of the operations carried out.

The company then sends an email confirming the recorded order, subject to full payment, followed by a second email sent to the member upon dispatch of the products with the tracking number, depending on the carrier.

Article 8 – Product unavailability

Despite all precautions implemented, a product ordered and purchased may become unavailable.

In the event of permanent unavailability, in accordance with the provisions of Article L121-20-3 of the French Consumer Code, the company undertakes to refund the product and the shipping costs in full, via the payment method used by the Buyer when placing the order, as soon as possible.

An email will be sent to the Buyer to inform them that their card has been credited and that their purchase has been refunded.

Article 9 – Delivery terms

9.1. Delivery areas and methods

Orders are delivered within mainland France and the following European countries: Belgium, Luxembourg, the Netherlands, Germany, Austria, Italy, Switzerland and other countries subject to availability.

All deliveries require the signature of the recipient or any person present at the delivery address. The carrier may request proof of identity when handing over the parcel.

9.2. Delivery times

Indicative delivery times, from shipment of the order, are as follows:

  • Mainland France: 3 to 10 working days

  • Europe: 5 to 20 working days

These timeframes are provided for information purposes only and may vary depending on destination and transport conditions. A shipping confirmation email including the tracking number is sent to the customer.

In the event of a delay in delivery not attributable to the Seller, no refund of shipping costs will be made.

9.3. Customer responsibility – Delivery address

The customer is solely responsible for the accuracy and completeness of the delivery address provided when placing the order. In case of error, omission or incorrect address, the Seller cannot be held liable for non-delivery or delayed delivery.

The customer must ensure that they, or a person authorised to receive the parcel, is available at the delivery address. In case of absence during the first delivery attempt, the carrier will leave a delivery notice. The customer then has a limited period to collect the parcel in accordance with the carrier’s instructions.

9.4. MANDATORY inspection upon delivery

IMPORTANT: The customer is REQUIRED to check the condition of the parcel and its contents IN THE PRESENCE of the delivery person, BEFORE signing the delivery slip.

If any anomaly is detected upon delivery (damaged, opened or crushed parcel, missing or damaged product), the customer MUST:

  1. REFUSE the parcel if it is clearly damaged, opened or suspicious;

  2. OR record PRECISE AND DETAILED RESERVATIONS on the delivery slip (exact nature of the damage, missing items, etc.) in the presence of the delivery person.

Signing the delivery slip without reservation constitutes acceptance of the parcel and a presumption of conformity of the delivery. No claim relating to apparent damage will be accepted if the delivery slip has been signed without reservation.

9.5. Time limit for claims relating to apparent damage

If the customer has entered reservations on the delivery slip or discovers apparent damage after signing, they have a MANDATORY period of 2 working days from the date of delivery to:

  • Confirm their reservations by email to info@kaitsuko.fr

  • Attach clear photos of the outer parcel, inner packaging and damaged product

  • Provide a copy of the delivery slip showing the reservations made

After this 2-working-day period, no claim relating to apparent damage will be admissible. Late claims will be systematically rejected.

9.6. Uncollected parcels

If the customer does not collect the parcel within the time limit set by the carrier (generally 14 days after the first delivery attempt), the parcel will automatically be returned to the sender.

In such cases, the fees and terms set out in Article 10.8 (Uncollected parcels and returns to sender) will apply in full.

No refund of the initial shipping costs will be made. The customer will have to pay the return and logistics processing fees in order to obtain a refund or reshipment.

9.7. Lost or stolen parcels

In case of a parcel declared lost by the carrier or stolen after delivery, the customer has 30 days from the date of shipment to inform the Seller by email at info@kaitsuko.fr.

An investigation will be opened with the carrier. This investigation may take 15 to 30 days. At the end of the investigation, depending on the conclusions:

  • If the loss is confirmed: a new shipment or a refund will be issued;

  • If the parcel has been delivered and signed for: no further recourse will be possible.

After the 30-day period, no investigation can be initiated and no claim will be admissible.

9.8. Verification of conformity

The customer must check the conformity of the products delivered (references, quantities, specifications) immediately upon opening the parcel.

Any non-conformity or hidden defect must be reported under the conditions laid down in Articles 10.3.1 (defective products) and 11 (legal guarantee of conformity).

Article 10 – Right of withdrawal and returns

This Article sets out the conditions for exercising the statutory right of withdrawal and the procedures for returning products purchased on www.kaitsuko.nl, in accordance with the French Consumer Code.

10.1. Statutory right of withdrawal (14 days)

In accordance with Articles L221-18 and following of the French Consumer Code, the customer has a period of 14 days from receipt of the order to exercise their right of withdrawal, without having to provide any reason.

Any return request must be submitted exclusively via: https://kaitsuko.aftership.com or, failing that, by email to info@kaitsuko.fr. Requests submitted via any other channel will not be processed.

10.2. Mandatory return procedure

The customer must use the official return platform for any request. Any parcel sent without prior validation via the platform will not be refunded or processed.

Once the request is approved, the customer has 7 days to ship the parcel. Returns sent after this period may be refused.

10.3. Distinction: defective products vs discretionary returns

Return processing differs depending on the nature of the issue:

10.3.1. Defective, damaged or non-conforming products

Reporting anomalies (deadline: 2 calendar days)

The customer must check the integrity and conformity of the order upon delivery. Any apparent anomaly (missing item, visible defect, damaged product, wrong model or colour) must be reported via the return platform or by email within 2 calendar days, with photos of the product and packaging.

After this period, no claim relating to an apparent defect will be accepted.

Full coverage

When a non-conformity is reported within the deadlines and confirmed by our teams, Kaitsuko will fully cover the return:

  • A prepaid return label is provided free of charge;

  • No logistics processing fee applies;

  • No return shipping costs are charged.

The customer then has 7 days from receipt of the label to ship the parcel.

Solutions offered

After inspection of the product, Kaitsuko may offer:

  • Replacement with an identical product (subject to availability);

  • Exchange for an equivalent product;

  • Full refund via the original payment method;

  • Store credit for the exact amount paid.

Exclusions from coverage

Free return coverage will not apply if:

  • The product has been used;

  • The damage results from improper handling;

  • Wear results from normal use;

  • The evidence provided is insufficient to establish the non-conformity;

  • The claim was submitted after the deadline for apparent defects.

In such cases, the request will be treated as a discretionary return (see Article 10.3.2).

10.3.2. Discretionary returns (exercise of the right of withdrawal)

Returns in the context of the statutory right of withdrawal are subject to the fees described in Article 10.5.

10.4. Return eligibility conditions

To be accepted, any returned product must meet all of the following conditions:

  • Be strictly unused;

  • Be in perfect condition, without any mark, scratch or damage;

  • Be returned in its complete original packaging (box, case, protective materials, accessories, documentation);

  • Be carefully packed in a box providing sufficient protection;

  • Be accompanied by a document indicating the customer’s identity, order number and contents of the parcel.

Important: In accordance with Article L221-23 of the French Consumer Code, any product showing depreciation may be subject to a deduction of up to 100% of its value.

10.5. Fees applicable to discretionary returns

10.5.1. Logistics processing fee (mandatory)

A flat fee of €10.00 will systematically be deducted from the refund to cover the costs of receiving, inspecting and processing the return, even if the customer sends back the product at their own expense.

In addition, a flat fee of €1.99 per item will be applied from the second item returned in the same order.

10.5.2. Optional prepaid return label

If the customer chooses to use the label provided by Kaitsuko, the following amounts will be deducted depending on the destination country:

  • France: €6.99

  • Belgium / Luxembourg / Netherlands / Germany / Austria: €8.99

  • Italy: €9.99

  • Switzerland and other European countries: €19.99

10.5.3. Return at the customer’s own expense

The customer may ship the product at their own expense only after validation of the request via the dedicated platform. Shipping costs paid by the customer are non-refundable.

Return address:

17600 Figueres, Girona

10.6. Product inspection and possible depreciation

Upon receipt of the parcel, Kaitsuko will conduct a full inspection of the returned product.

If the product is used, incomplete, scratched, damaged or insufficiently protected, a proportional depreciation may be applied, up to 100% of its value, in accordance with Article L221-23 of the French Consumer Code.

In the event of a total deduction, no refund will be issued. The customer may, however, request reshipment of the product, subject to the applicable fees indicated in Article 10.8.

10.7. Refund methods

10.7.1. Refund to the original payment method

Calculation formula:

Refund amount = Value of returned product – €10.00 (logistics processing fee) – return label fee (if applicable)

The refund will be made within 14 days after receipt and inspection of the returned product, in accordance with Article L221-24 of the French Consumer Code.

10.7.2. Store credit with 15% bonus

The customer may opt for a store credit valid on the entire website www.kaitsuko.nl, calculated after deduction of any applicable fees and then increased by 15%.

This store credit is not refundable in cash.

10.8. Uncollected parcels and returns to sender

When a parcel is not collected by the customer within the timeframe set by the carrier, it is automatically returned to the sender.

10.8.1. Refund after return to sender

If the customer requests a refund following a return due to non-collection, the following amounts will be deducted depending on the origin country of the parcel:

  • France: €19.99

  • Belgium / Luxembourg / Netherlands / Germany / Austria: €24.99

  • Italy: €26.99

  • Switzerland and other European countries: €39.99

These amounts cover logistics processing fees and additional fees charged by the carrier for the return of the parcel.

10.8.2. Reshipment of the parcel

If the customer wishes to have the order reshipped, the following fees will apply:

Reshipping fees by country:

  • France: €6.99

  • Belgium / Luxembourg / Netherlands / Germany / Austria: €8.99

  • Italy: €9.99

  • Switzerland and other European countries: €19.99

Handling fee for reshipment: €4.99

Reshipment will be carried out after full payment of these fees.

10.8.3. Lack of instruction from the customer

If no instruction is received from the customer within 14 days after notification of the return to sender, the order will be considered abandoned. No reshipment or compensation may be claimed.

10.9. Products excluded from the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the following cannot be returned:

  • Gift cards;

  • Digital products or downloadable files;

  • Customised or personalised products (where applicable);

  • “Mystery knife” operation: for this type of marketing campaign, returns and refunds are not accepted, as the customer acknowledges that they do not know which knife they will receive.

10.10. Discounted products

Discounted products may be returned under the same conditions as non-discounted products, in accordance with the above Articles.

10.11. Model withdrawal form

In accordance with Article L221-5 of the French Consumer Code, the customer may use the following standard form to exercise their right of withdrawal:

To the attention of Kaitsuko

I/We () hereby notify you of my/our () withdrawal from the contract relating to the sale of the product below:

Ordered on () / received on ():

Name of consumer(s):

Address of consumer(s):

Signature of consumer(s) (only if this form is submitted on paper):

(*) Delete as appropriate.

Article 11 – Warranty and liability

Upon receipt of the Products, the Customer must check the condition of the packaging and the integrity of the Products delivered and, where appropriate, make any reservations or claims on the carrier’s delivery note, and inform the Seller by sending a copy of the reservations made to the carrier by post or email within 2 working days following the date of delivery of the Products, at the following address: info@kaitsuko.nl.

The Customer must also notify the Seller, within 2 days from delivery, of any claim relating to delivery error and/or missing items. Any claim submitted after this period will be rejected with no possibility of recourse.

The Customer is also required to check the conformity of the Products received with the order at the time of delivery. Any non-conformity or defect must be reported to the Seller within the statutory deadlines.

In this respect, it is recalled that the Seller is liable for lack of conformity of the Product under the conditions set out in Articles L.211-4 et seq. of the French Consumer Code and for hidden defects of the item sold under the conditions provided for in Articles 1641 et seq. of the French Civil Code.

When acting under the legal guarantee of conformity, the Customer:

  • has a period of two years from delivery of the goods in which to take action;

  • may choose between repair or replacement of the goods, subject to the cost conditions laid down in Article L.211-9 of the French Consumer Code;

  • is exempted from providing proof of the existence of the lack of conformity of the goods during the 24 months following delivery.

The legal guarantee of conformity applies independently of any commercial warranty that may have been granted.

The Customer may decide to invoke the warranty against hidden defects in the item sold as defined in Article 1641 of the Civil Code, in which case they may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

Purchase of the Lifetime Warranty*:

The “lifetime” warranty has a duration of 20 years. Each warranty purchased applies to a single knife. It cannot be combined or applied to a pack/set of knives.

The warranty therefore does not apply if:

  • the knives have been washed in a dishwasher rather than by hand;

  • the knives have not been stored in a dry place;

  • the knives have not been wiped with a cloth after washing, particularly wooden handles;

  • an abrasive sponge or similar has been used to clean the blade;

  • the sharp edge of the blade has been used to push food across a board, causing the edge to break.

The warranty does not cover stains that may appear on the blades.

Such stains are normal: the high carbon content of the blades may cause staining. However, these can be avoided by strictly following the instructions provided with the set and/or indicated on our website.

In the event of a return for non-conformity or hidden defect, the Customer must submit a request to the Seller’s customer service by email at: info@kaitsuko.fr, providing a detailed description of the defect or non-conformity observed.

Returns are excluded where the defect is due to improper handling, improper care or use of the Product contrary to its intended purpose by the Customer.

The Seller will examine the Customer’s request and will, if it is found to be justified, proceed, at the Customer’s choice, with the exchange or refund of the Product(s), as well as the shipping and return costs.

No return for non-conformity or hidden defect will be accepted without prior approval from the Seller.

In any event, the warranty is excluded in the event of non-compliance by the Customer with the “Instructions for use, care and safety of the Products” or in the event of abnormal use of the Products, or use for purposes other than those for which they were designed.

The warranty does not cover breakage of the product but only abnormal deterioration of the blade. Certain resin handles are fragile and must be handled with particular care and attention.

Article 12 – Intellectual property

All elements of the website are and remain the intellectual and exclusive property of the publishing company.

As such, and in accordance with the provisions of the French Intellectual Property Code, no one is authorised to reproduce, exploit, redistribute or use any element of the website, in whole or in part, for any purpose whatsoever other than private use, without the company’s consent.

The creation of simple or hypertext links using “framing” or “deep linking” techniques to the website is strictly prohibited.

The reproduction, copying or exploitation of the company’s website or any part thereof, for any purpose whatsoever, is strictly prohibited without the company’s express written authorisation.

Any copying, use for commercial purposes or unfair competition based on the same sales model as the company is strictly prohibited and may result in legal action and sanctions for intellectual property infringement.

Article 13 – Confidential data

All member information and data are strictly confidential. The company undertakes to use this information exclusively within the framework of operating its website. To this end, the company undertakes not to sell or rent member data to third parties.

In accordance with Article 34 of the French Data Protection Act of 6 January 1978 (“Informatique et Libertés”), members have the right to access, modify and suspend data relating to them. To exercise this right, the member may write via the Contact section.

The company undertakes to immediately delete members wishing to be removed from its database.

Article 14 – Hosting

This website is hosted by:

Shopify
150 Elgin Street, Suite 800, Ottawa, ON K2P 1L4, Canada

Article 15 – Disputes

In the event of a dispute between the Consumer Client and the Seller, the parties will endeavour to resolve it amicably (the Client shall send a written complaint to Customer Relations).

If no amicable agreement is reached or if there is no response within a reasonable period of one (1) month, the Consumer Client may refer the matter free of charge, if a dispute persists, to a mediator listed by the Commission for the Evaluation and Control of Consumer Mediation in accordance with Article L.615-1 of the French Consumer Code.

Article 16 – Grounds for exemption (Force majeure)

The Seller shall not be liable in cases of force majeure affecting, in particular, the production, dispatch or delivery of the products.

Force majeure events shall include, in particular, any event affecting the Seller or its suppliers, such as delays or disruptions in production resulting in whole or in part from destruction of production facilities, war (declared or undeclared), strikes, annual plant shutdowns, national events, labour disputes, riots, accidents, flooding, natural disasters, transport delays, material shortages, tool breakdowns, damage to machinery or equipment of any kind, fire, interruption or reduction of supplies of energy or raw materials.

In such circumstances, the Seller will benefit from additional time to perform its obligations, without any compensation being claimable. Any force majeure event must be notified to the other party within 10 days of its occurrence.

Article 17 – Mediator

The consumer mediation process can only be initiated at the consumer’s request (the professional cannot initiate it). However, the consumer may only refer the matter to the mediator if they have previously attempted to resolve the dispute by submitting a written complaint directly to the professional concerned or its customer service. If this prior step is not taken, the mediation request will be inadmissible.

In accordance with Article L.612-1 of the French Consumer Code, in the event of a dispute, you may refer the matter to a Consumer Mediator.
